1. Agreement to terms

By accessing or using Xofanic ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, readers, creators, and anyone else who accesses the Service.

2. Changes to terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by updating the date at the top of this page and, where appropriate, by notifying registered users by email. Your continued use of the Service after changes take effect constitutes acceptance of the new terms.

3. Accounts

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@xofanic.com if you suspect unauthorized access to your account.

You may not create accounts using automated means, maintain multiple accounts for abusive purposes, or create accounts under false pretenses.

4. User content

You retain all ownership rights to the content you publish on Xofanic, including stories, chapters, images, and any other materials you upload ("User Content").

By publishing User Content on Xofanic, you grant Xofanic a non-exclusive, worldwide, royalty-free license to host, display, store, and distribute your content solely for the purpose of operating and improving the Service. This license does not give Xofanic the right to sell or sublicense your content to third parties.

You represent and warrant that you have the necessary rights to publish your User Content and that it does not violate any third-party intellectual property rights, privacy rights, or applicable law.

5. Prohibited conduct

You agree not to:

• –Upload content that you do not own or have the right to distribute
• –Harass, threaten, or abuse other users or creators
• –Attempt to scrape, reverse-engineer, or disrupt the Service
• –Use the Service to distribute spam or malware
• –Impersonate other users, creators, or Xofanic staff
• –Circumvent any access controls or security measures
• –Upload content that is hateful toward protected groups

6. Intellectual property

Xofanic's name, logo, interface design, and original platform content are the intellectual property of Xofanic and may not be used without written permission. User Content remains owned by its respective creators.

7. Termination

We may suspend or permanently terminate your account at our discretion, without prior notice, for conduct that violates these Terms or that we determine to be harmful to the Service or other users. You may delete your account at any time from the Personal Data page.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no representations about the accuracy or completeness of any content on the Service.

9. Limitation of liability

To the maximum extent permitted by applicable law, Xofanic shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction as required by applicable law.
